1. Acceptance of TermsBy accessing and using the services of Global Freight Logistics ("Company"), you ("Client") agree to be bound by these Terms and Conditions. These terms govern all freight forwarding, warehousing, customs brokerage, and logistics services provided by the Company
.2. Scope of ServicesThe Company acts as an international freight forwarder and logistics coordinator. We arrange for the transportation of goods via ocean, air, rail, and land carriers, as well as handle warehousing, consolidation, and customs documentation as agreed upon in individual service contracts.
3. Rates, Quotations, and PaymentQuotations: All price quotes are subject to space availability and may change due to fluctuating fuel surcharges, port fees, carrier rates, and currency exchange rates.Payment Terms: Payment for all services, duties, taxes, and fees must be rendered according to the agreed-upon credit terms or prior to the release of cargo.Late Payments: Unpaid balances beyond the agreed due date will incur interest charges at the maximum rate permitted by law.
4. Documentation and ComplianceAccuracy: The Client is solely responsible for providing complete, accurate, and truthful documentation, including commercial invoices, packing lists, and customs declarations.Regulatory Adherence: The Client guarantees that all shipments comply with all applicable import/export laws, international trade regulations, and customs requirements.
5. Restricted and Hazardous GoodsDangerous goods, hazardous materials, and restricted cargo will only be accepted with prior written agreement. The Client must properly label, package, and declare all hazardous materials in strict accordance with international safety standards (e.g., IMDG, IATA, ADR)
.6. Liability and LimitationsCarrier Liability: The Company’s liability for lost, damaged, or delayed cargo is strictly limited in accordance with applicable international conventions (e.g., Hague-Visby Rules, Warsaw Convention, CMR) and national maritime/freight laws.Force Majeure: The Company is not liable for service delays or cargo loss caused by events beyond its reasonable control, including acts of God, war, port congestion, strikes, severe weather, or government actions
.7. Cargo InsuranceStandard freight forwarding services do not include comprehensive cargo insurance. The Company strongly advises Clients to purchase third-party marine and transit insurance to fully protect their shipments against risk of loss or damage.
8. Right to LienThe Company retains a general and continuing lien on any and all property (and documents relating thereto) within its possession, custody, or control for all claims, freight charges, duties, or expenses owed by the Client.
9. Claims and Time LimitsAny claim for loss, damage, or discrepancy must be submitted to the Company in writing within the specific timeframes mandated by the applicable transit mode or law (typically within 7 to 14 days of cargo delivery). Failure to provide timely notice constitutes a waiver of the claim.
10. Governing Law and JurisdictionThese Terms and Conditions shall be governed by and construed in accordance with applicable federal and international maritime laws. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in the Company’s primary legal registration district.
